This document constitutes a legally binding agreement between the user (hereinafter "you", "User", or "Parent/Guardian") and LLC Tail Global (hereinafter "the Company", "Tail", "we", or "us"). By accessing our website, mobile applications, or purchasing products, you agree to be bound by these Terms and Conditions.

  1. Description of Service 1.1. Platform Function: Tail (operated by LLC Tail Global) provides an AI-powered custom publishing platform that generates personalized children's storybooks, digital files (PDFs), and digital animations based on user inputs and photos. 1.2. Product Types: Services include both non-tangible digital goods (e.g., downloadable PDFs, video animations) and customized physical printed hardcopy/softcover books.

  2. Ordering Process, AI Generation & Parental Representation 2.1. Preview and Approval: Prior to purchase, the platform generates a preview sample of the personalized content. By completing the payment, you fully approve and accept the visual layout, character design, and text rendered in the preview. 2.2. Artificial Intelligence Imperfections: You acknowledge and agree that Artificial Intelligence technology is generative and not flawless. Minor visual anomalies, stylistic inconsistencies, or creative rendering variations may occur and do not constitute a product defect. 2.3. Image Uploads and Authority: You represent and warrant that you are the parent, legal guardian, or authorized adult with full rights to upload photographs of any minor child. You grant the Company a temporary, non-exclusive license to process uploaded images solely for generating the personalized product. 2.4. Image Quality: Final character similarity depends directly on the lighting, resolution, and quality of the uploaded photo. The Company is not liable for reduced similarity resulting from low-resolution or poor-quality source files.

  3. Shipping, Delivery, and Risk of Loss 3.1. Digital Deliverables: Downloadable PDFs and digital animations are delivered electronically immediately upon completed AI processing and payment verification. 3.2. Physical Printed Books: Standard print-on-demand fulfillment and delivery generally takes 10 business days. Delivery times to remote areas, US Territories, or international addresses may vary. 3.3. Shipping Address Accuracy: You are solely responsible for providing an accurate and complete shipping address. Re-shipping costs for orders returned due to invalid addresses provided by the User will be billed to the User. 3.4. Risk of Loss: Title and risk of loss for all physical items pass to you upon our transfer of the package to the shipping carrier (USPS, UPS, FedEx, or regional partners).

  4. Returns, Cancellations, and Refund Policy 4.1. Personalized Items Non-Returnable: Because all products are uniquely generated and custom-printed for individual children, orders cannot be returned, exchanged, or canceled once printing or digital processing has commenced. 4.2. Damaged or Defective Items: If a physical product arrives damaged, misprinted, or physically defective, you must contact us at info@tail.kids within 14 days of delivery with photos of the defect. We will issue a free reprint and replacement for verified claims. 4.3. Refund Policy Reference: All return and refund requests are governed strictly by our dedicated [Refund Policy].

  5. Intellectual Property Rights 5.1. Proprietary Content: The website architecture, design, branding, story templates, software code, and underlying AI prompt systems remain the exclusive property of LLC Tail Global. 5.2. Personal Use License: Upon purchase, the Company grants you a perpetual, non-exclusive, personal, non-commercial license to retain, read, and share the customized digital or physical book with your immediate family. Commercial resale, redistribution, or public distribution is strictly prohibited.

  6. Children's Privacy (COPPA Statement) & Data Processing 6.1. Parental Consent: Our services are intended to be purchased by adults (parents or legal guardians). We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent. 6.2. Photo Data Retention: Original photos uploaded by users and temporary AI processing models are automatically deleted from our primary storage systems within 30 days post-delivery, in accordance with our [Privacy Policy].

  7. Disclaimer of Warranties & Limitation of Liability 7.1. "AS IS" BASIS: THE SERVICE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 7.2. LIABILITY CAP: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LLC Tail Global, ITS DIRECTORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

  8. Governing Law and Binding Arbitration 8.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of the State of Delaware (or applicable US state of incorporation), without regard to its conflict of law principles. 8.2. Mandatory Arbitration & Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these terms shall be settled by binding arbitration administered by the American Arbitration Association (AAA). YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
